Legal aid can provide important cost relief in enforcement proceedings. Section 78 of the Austrian Enforcement Code refers to the legal aid rules of the Code of Civil Procedure for the relevant requirements and effects, unless the Enforcement Code provides a specific rule.

The court examines financial need, the prospects of the specific proceeding and the exact benefits requested. Legal aid does not replace a review of the court file and does not remove every possible cost risk.

Which proceedings can be covered?

Section 78 of the Austrian Enforcement Code connects enforcement proceedings with the legal aid rules of the Code of Civil Procedure. The assessment concerns the specific proceeding and the specific procedural step. In a judicial auction, the enforcement file, court and role must therefore be identified precisely.

An application for legal aid in a separate civil dispute does not automatically cover every step in the enforcement proceeding. The type of proceeding and the benefit sought belong at the start of the application.

What requirements must be met?

Under section 63 of the Austrian Code of Civil Procedure, legal aid requires that the party cannot pay the costs of the proceeding because of its income and assets without impairing the necessary support of the party or persons dependent on it. The court assesses the personal and financial circumstances using the information and supporting documents provided.

The intended legal pursuit or defence must also be neither manifestly vexatious nor obviously hopeless. A clear description of the procedural stage and intended step helps the court assess the correct issue. Financial pressure alone does not satisfy every statutory requirement.

Which benefits may be requested?

Section 64 of the Austrian Code of Civil Procedure lists different possible benefits. Depending on the proceeding, these may include temporary relief from certain fees and expenses and the appointment of a lawyer. The court decides the benefits requested and their scope.

State the pending court action and the relief needed for it. The financial statement, supporting documents, file number and latest court correspondence should describe the same proceeding. Why timing matters

Legal aid is granted on application. The benefits generally take effect from the time of the application. Their effect cannot be assumed for costs that have already arisen. If a deadline or court step is approaching, prepare the application so that it reaches the competent court in time.

Secure the proof of service, the latest order and the relevant deadline. A legal review can also clarify whether the application concerns the enforcement step, a remedy or a separate civil dispute.

Which cost risks remain?

Legal aid does not remove every cost risk. A party may still have to reimburse costs awarded to another participant under the applicable rules. Repayment of deferred amounts may also be considered if the financial circumstances improve. Section 71 of the Austrian Code of Civil Procedure provides for a review within three years after the proceeding ends.

For a judicial auction, separate three questions: which costs arise from your own procedural step, which costs may be deferred or covered, and which risks towards other participants remain. This separation makes the application and financial planning understandable.

Important: Legal aid depends on the specific proceeding and financial circumstances. If a deadline is approaching, have the file, service record and application reviewed together without delay.
