Municipal property requires a separate review before it is pursued in enforcement under section 15 EO. The provision protects assets needed for public interests. The creditor therefore has to identify the property, its use and the statement of the competent administrative authority.

Section 15 EO concerns enforcement for monetary claims against a municipality or against an institution declared public and charitable by an administrative authority. The provision does not turn all municipal property into a blanket immunity. It requires the individual asset and its public function to be identified.

First assessment under section 15 EO

Is enforcement against the municipal property prepared with sufficient detail?

Classify the debtor, claim, property use and administrative statement. The result identifies the part of the file that still needs review.

01 Question 1

What is your role in the proceeding?

Section 15 EO focuses on the debtor, the type of claim and the specific asset that would be used to satisfy the creditor.

Overview of all outcomes.

01

Match the administrative statement to the property

Match the statement of the competent administrative authority to the specific property, its use and the monetary claim. A general statement about municipal assets does not complete the section 15 EO review.

Open the file check →
02

Review the contractual mortgage separately

Section 15 EO expressly excludes enforcement of a contractual mortgage. Review the mortgage deed, security, title and procedural form as a separate matter.

Review title and property enforcement →
03

Distinguish claim enforcement and mortgage enforcement

Record whether the case concerns an unsecured monetary claim or enforcement of a contractual mortgage. That classification determines how the special limit in section 15 EO is assessed.

Organise the documents in the file check →
04

Review public interests at the specific property

Connect the administrative statement with the use of the property and the claim. That is the basis for assessing whether the asset can be used without impairing the public interests protected by section 15 EO.

Distinguish administration and proceeds →
05

Complete the municipality file under section 15 EO

Record the owner, land register data, use, public function and any administrative statements in one file. The documents must identify the specific asset under review.

Prepare the file check →
06

Clarify public use and the specific asset

Ownership and land register data alone do not answer the section 15 EO question. Add the current use, the stated public purpose and the statement of the competent administrative authority.

Organise missing documents →

Review another immunity or enforcement framework

Section 15 EO names municipalities and certain public and charitable institutions. Foreign states, diplomatic institutions and other debtors require a separate review.

Which property falls within section 15 EO?

Section 15 EO governs enforcement against a municipality or against an institution declared public and charitable by an administrative authority. It concerns enforcement for monetary claims. The provision focuses on the specific asset that would be used to satisfy the creditor.

A municipal property therefore requires a two-level review. First, the debtor and the claim must fall within the personal and material scope of the provision. The next question is whether this particular property can be used without impairing the public interests that the municipality has to protect.

Section 15 EO does not establish a blanket rule that every property owned by a municipality is immune from enforcement. Ownership by a municipality also does not by itself establish that the property may be enforced against. The use, public purpose and administrative statement remain central.

What does protection of public interests mean?

The test in section 15 EO is the possible impairment of public interests. The file therefore has to show which public task is performed at the property and what enforcement would mean for that task. A town hall, works depot, school or undeveloped reserve may have different factual functions. The label alone does not answer the question.

The review should distinguish ownership, current use and future public need. A property may be owned by the municipality while its specific use remains undecided. A site may also be reserved for a public task even when the land register does not describe that use.

For the creditor, this calls for a precise allocation in the enforcement file. For the municipality, it calls for evidence of the stated public purpose through use records, resolutions or the administrative statement. Section 15 EO does not replace that factual assessment.

Review framework

Which question belongs to which review?

The ownership label, public use and legal right must remain separate.

Boundaries for reviewing enforcement against real property
Review point Section 15 EO Separate review
Debtor Municipality or institution declared public and charitable Foreign state, diplomatic institution or another legal entity
Claim Monetary claim to be satisfied from an eligible asset Title, maturity, objections and enforcement form
Property Use without impairment of public interests must be assessed Land register, use, third-party rights and economic realisation
Legal security Contractual mortgage enforcement is excluded by the wording Mortgage deed, title and procedural requirements
Key document Statement of the state administrative authority on the asset Other jurisdictional or immunity evidence as required

The result depends on the title, the property, its use and the complete file.

Which administrative statement is decisive?

Section 15 EO provides that state administrative authorities declare the extent to which specific assets can be used without impairing public interests. The statement therefore concerns the asset and its use. For real property, the link to the land register description and actual use should remain clear.

A general statement about the municipality’s financial position does not provide that allocation. A reference to the public character of the owner is also insufficient. The file should identify the authority, the property covered and the statement that matters for the monetary claim.

The administrative statement answers the specific section 15 EO issue. It does not replace the enforcement title or the review of jurisdiction, claim amount and other objections. Those questions remain separate parts of the file.

How should the property be described in the enforcement application?

Before applying, the creditor and the municipality should use the same identifying data. This includes cadastral municipality, title register number, plot number, owner, current use and the claim. Each property should be treated separately where several properties are involved.

The full administrative statement belongs in the file. The application should make clear whether it covers the entire asset, part of it or a particular use. Vague collective descriptions make it harder to assess whether enforcement would impair the public interests protected by section 15 EO.

This is a practical preparation step. It does not create an additional statutory form requirement. It prevents ownership, land register asset, use and administrative statement from being mixed in the proceeding.

Before the enforcement application

From the claim to a reliable property file

Each stage answers a different section 15 EO question.

  1. 01
    Claim

    Organise claim and title

Record amount, debtor, title and intended enforcement form separately.

  2. 02
    Debtor

    Classify municipality or institution

Check whether the personal scope of section 15 EO is met.

  3. 03
    Property

    Match land register and use

Describe the specific property, its use and its public function.

  4. 04
    Authority

    Include the statement

Match the competent authority’s statement to the asset.

  5. 05
    Boundary

    Review mortgage and immunity separately

Contractual mortgage enforcement and diplomatic immunity raise different questions.

  6. 06
    Application

    Show open factual points

Use only clarified property and use data in the application.

When does the contractual mortgage exception apply?

The final part of section 15 EO excludes enforcement of a contractual mortgage. This is an express boundary in the wording of the provision. Enforcement of an ordinary claim against an eligible asset must therefore be distinguished from realisation of a contractually created mortgage.

The classification requires the mortgage deed, land register entry, claim and title to match. Calling a right a mortgage does not complete the procedural review. The question is whether a valid contractual mortgage exists and which procedure the creditor is pursuing.

The exception does not remove the need for these documents. It only defines the reach of the special limit in section 15 EO. Other requirements and objections remain separate issues.

How is section 15 EO different from diplomatic immunity?

Section 15 EO names municipalities and institutions declared public and charitable by an administrative authority. That statutory rule cannot be transferred to foreign states or diplomatic institutions. Those cases follow a different public international and constitutional framework.

A foreign payment title also does not answer this boundary. Recognition and enforceability of a title are separate questions. The article Foreign payment title in Austria treats that connection separately.

The distinction prevents an incorrect conclusion. Protection of public interests for municipal property does not establish general state immunity or determine the position of diplomatic real property.

Which documents should be organised before applying?

For a section 15 EO review, keep the enforcement title, current claim statement and exact property description together. Add ownership evidence, a land register extract, a use description and any municipal or administrative records.

The central document is the statement of the state administrative authority on the use of the specific asset. If it is missing or cannot be matched to the property, the factual basis remains incomplete. The file should identify that open issue clearly.

The file check helps organise the records. Proceeds and ongoing income in an already ordered judicial administration follow their own rules, discussed in Costs after judicial administration.

Important: Section 15 EO requires a review of the specific asset and its meaning for public interests. Owner, land register data, use and administrative statement must match.
