Clarify the recognition and enforcement route
Start with the state of origin and applicable instrument. Establish whether a separate declaration is needed.

A foreign payment title gives access to Austrian real estate only after recognition and enforceability have been checked. The Austrian application must identify the title, parties, monetary claim and property clearly.
A separate declaration of enforceability may or may not be required, depending on the state of origin and applicable EU law or treaty. Section 2(2) of the Enforcement Code covers instruments enforceable without a separate declaration, while the application and property rules impose further requirements.

Start with the state of origin and applicable instrument. Establish whether a separate declaration is needed.
Organise the copy, certificate, service evidence and usable German translation.
Compare title, amount, debtor and land-register extract. Section 133 requires a precise object.
Check section 54 and the requirements under section 133.
Recognition asks whether a foreign decision is binding in Austria. Enforcement concerns the specific coercive measure. The two questions may be governed by different rules.
Section 2(2) covers foreign instruments enforceable under an international agreement or EU legal act without a separate declaration. In other cases, check an Austrian recognition or declaration procedure.
File a complete and readable copy of the decision and evidence that it is enforceable in the state of origin. Section 7 addresses certainty, maturity and confirmation of enforceability.
Depending on the instrument, a court certificate, proof of service, finality confirmation or specific certificate may be required. Foreign documents should include a usable German translation.
Before filing in Austria, establish whether the title can be used directly or an Austrian preliminary procedure is needed. Calling the judgment final does not replace a required declaration.
The applicable instrument determines the review, including where relevant jurisdiction, proper service and recognition barriers.
Section 54 requires the parties, specific claim, enforcement title and selected measure to be identified. These details must match the judgment and evidence.
Principal, interest, costs and payments should be transparent. For an auction of real estate, section 133 is the specific starting point.
Record the land-register entry, cadastral municipality and ownership position from a current extract. For condominium ownership or a share, define the scope of the measure.
A title against a particular debtor does not mean every property may be enforced against without review. Ownership, liens and ranking belong in the file.
An Austrian enforcement order does not itself mean the property has been auctioned. The procedure continues through land-register annotation, auction conditions and publication.
Keep service, payments and communications with the foreign court separate. A later payment, waiver or deferral may require an application to limit or discontinue enforcement.
Do not equate finality with enforceability in Austria. Filing only the judgment without evidence or a required translation is insufficient.
Inconsistent names or an economic description instead of precise land-register data make allocation difficult. Complete the three controls together: enforceability, debtor and property.
Sort the documents by their role in Austrian enforcement proceedings.
| Check | Typical document | Function |
|---|---|---|
| Title | Complete certified copy | Which claim and parties are covered |
| Enforceability | Certificate of enforceability | Whether enforcement is permitted in the state of origin |
| Service | Proof of service | Whether service and procedural participation can be shown |
| Property | Austrian land-register extract | Which property is intended |
The required documents also depend on the applicable EU instrument or treaty.
This order prevents an unresolved recognition issue from entering the enforcement application.
Check the EU instrument, treaty or domestic route.
Organise the copy, certificates and service records.
Check the required application and court.
Reconcile amount, debtor and land-register data.
Specify the enforcement method and documents.
Check service, annotation, auction and priority issues.
