An Austrian owner partnership gives the partners' half minimum shares a special legal connection. While the partnership exists, the shares may be restricted, encumbered or subjected to enforcement only together. A title against one partner therefore follows a specific procedural route.

Section 13 of the Austrian Condominium Act links that route to seizure of the claim to dissolve the common condominium ownership and an application to auction the entire minimum share. The other partner remains a participant in the proceedings. A section 37 objection also depends on whether the condominium unit serves that partner's urgent housing need.

01

Review participation and the objection route

Organise the title, land-register status and actual residential use. The other partner is a participant and may use remedies to protect their rights as a debtor could. If the statutory housing condition is met, also review an objection under section 37 of the Enforcement Code.

02

Document residential use and procedural status

Secure residence records, evidence of actual use, the land-register extract and all court documents. The housing condition and the stage of enforcement must be assessed from the specific file.

03

Align the entire minimum share with the procedure

Compare the enforcement title, seizure of the claim to dissolve the common condominium ownership, application for auction and court orders. For a title against one partner, section 13(3) specifies the connected procedural route.

04

Review consent and joint disposal

Record the intended transfer or encumbrance and the other partner's consent. Under section 13 of the Condominium Act, each partner may dispose of their share in the minimum share only with the other partner's consent.

What section 13 changes in an owner partnership

An owner partnership requires each partner to own half of a minimum share. The statute calls this holding a share in the minimum share. At the time the partnership is created, the partners' shares may not be encumbered differently.

Common condominium ownership connects the shares for as long as the owner partnership exists. The shares are then treated together for restrictions, encumbrances and enforcement. This connection is the starting point for every review of creditor access.

How a title against one partner is enforced

Where the enforcement title is against one partner only, section 13(3) of the Austrian Condominium Act describes a special route. Enforcement proceeds through seizure of the claim to dissolve the common condominium ownership, combined with an application to auction the entire minimum share and the associated common condominium ownership.

The creditor's access therefore follows the legal structure of the partnership. The individual half share is not treated as a freely realisable ideational quota while the partnership continues. The title, seizure, application and court orders must be reviewed as one procedural record.

Separate the legal structures

Owner partnership and ordinary co-ownership share

The ownership and land-register structure determines the first review
Review point Owner partnership Ordinary ideational share
Holding Each partner owns half of a minimum share, connected under section 13 An independent ideational quota whose legal basis must be established separately
Title against one person Access to the connected shares follows the special route in section 13(3) The rules for an owner partnership do not apply automatically
Other affected person The other partner is a participant and may protect their rights in the proceedings Standing depends on the specific ownership and procedural relationship

What rights the other partner has in the proceedings

The partner without the enforcement title is a participant in the enforcement proceedings. Section 13(3) gives that partner the remedies needed to protect their rights as if they were the debtor. Their role therefore extends beyond receiving information about the case.

The other partner may also object to the enforcement under section 37 of the Enforcement Code where the enforcement concerns the condominium unit that serves their urgent housing need. The relevant condition must be shown from the proceedings and from the actual use of the unit.

Section 37 requires a third-party objection to be brought as an action. The action may be directed against the enforcing creditor and the debtor. Jurisdiction depends on whether the action is brought before or after enforcement has begun. If the action is finally upheld, the enforcement is to be stopped.

Why actual residential use matters

The statutory objection is connected to the function of the condominium unit for the other partner. The relevant question is whether the unit serves that partner's urgent housing need. The existence of an owner partnership alone does not answer this factual question.

The file should therefore record actual use, the relevant period and the partner's personal housing situation. Documents showing the partner's connection with and ongoing use of the unit can support this review. A land-register extract alone does not establish residential use.

The housing condition is separate from the general participation of the other partner. That partner remains involved and may protect their rights. Whether section 37 also provides an objection depends on the statutory condition and the procedural stage.

What applies to a transfer or encumbrance of a share

Each partner may sell their share in the minimum share only with the other partner's consent. This consent rule operates alongside the rule that the connected shares may be restricted, encumbered or subjected to enforcement only together while the partnership exists.

The partners may also dispose of the common condominium ownership and the use of the condominium unit only jointly. A planned transfer or encumbrance therefore requires a joint review of the declaration, consent and ownership structure.

The statutory framework is designed for the owner partnership. A contract may add relevant information, yet the contract, land register and current procedural status still have to be compared.

Review path for the case file

From the enforcement title to the right objection

Each step clarifies a different condition for enforcement against linked minimum shares.

  1. 01
    1

    Establish the ownership structure

Compare the land register and the basis of the owner partnership with the two half minimum shares.

  2. 02
    2

Read the title and access route

Identify the partner named in the title and check whether seizure and auction application follow section 13(3).

  3. 03
    3

    Secure participation

Record the other partner as a participant and document the remedies and objections available to protect their rights.

  4. 04
    4

    Prove residential use

Review actual use and urgent housing need from the documents in the specific case.

Which documents should be aligned before the next step

The first review should bring together the enforcement title, the land-register extract and the documents establishing the owner partnership. Add the seizure order, the application for auction, proof of service and the current procedural status.

If the other partner is considering an objection under section 37, also document actual residential use, the personal housing situation and the connection with the condominium unit. Arrange the documents by subject and date so that the relevant procedural stage remains clear.

For a planned disposal, read the declaration, the other partner's consent, the current land-register status and any court restrictions together. The review of power of attorney and representation concerns a different act, yet it illustrates why a person's role and declaration must be recorded precisely in auction proceedings.

The article on an ordinary co-ownership share in a judicial auction helps distinguish the two structures. For a business-operated property, the separate issue of a trade licence may require its own review.

Important: A title against one partner does not permit an isolated auction of that partner's half share while the owner partnership exists. Section 13(3) sets out the connected procedural route. The other partner's rights and the housing condition require a separate review of the case file.
FAQ

Questions about linked minimum shares

Can a creditor auction only one partner's half minimum share? +
While the owner partnership exists, section 13(3) connects the shares. Where the title is against one partner only, the statute describes seizure of the claim to dissolve the common condominium ownership together with an application to auction the entire minimum share and the associated common condominium ownership.
What position does the partner without the title have? +
That partner is a participant in the enforcement proceedings and may use remedies to protect their rights as a debtor could. Where the urgent housing condition is met, the partner may also review an objection under section 37 of the Enforcement Code.
When can an objection under section 37 be considered? +
Section 13(3) refers to an objection where the enforcement concerns the condominium unit that serves the other partner's urgent housing need. Section 37 provides for an action. Actual use and the procedural stage must be established in the individual case.
What should I check before a planned transfer? +
Each partner may sell their share in the minimum share only with the other partner's consent. The ownership structure, land-register status and any court restrictions should also be compared.
Does section 13 apply to every co-ownership share? +
Section 13 governs the owner partnership with connected half minimum shares. An ordinary ideational quota has to be classified separately according to its ownership and procedural structure.
