If a titled claim is assigned during enforcement against real property, the new creditor must prove the change to the enforcement court with documents. A private assignment agreement alone therefore does not answer whether enforcement can continue in favour of the new creditor.

Section 9 EO requires public or publicly certified documents proving that the claim recognised in the enforcement title has passed to the person seeking enforcement. If that proof cannot be produced, section 10 EO requires a court judgment before enforcement is authorised or continued. The document and the current stage of the case are the starting points.

01 Question 1

What is already available for the creditor change?

All paths at a glance

Overview of all outcomes.

01

Prepare continuation

Connect the document with the enforcement title and file number. The application to the enforcement court should identify the transfer, the former party and the current stage of the proceeding.

Order the court communication →
02

Identify the claim precisely

Compare parties, title, file number, claim scope and assignment document. If it remains unclear which titled claim was transferred, the continuation request is not reliably prepared.

Order the claim and file →
03

Complete documentary proof

Check whether the transfer can be proved by a public or publicly certified document. Section 9 EO ties enforcement in favour of another person to this documentary proof. A private contract does not automatically satisfy that requirement.

Distinguish creditor roles →
04

Secure title and file stage

Secure the enforcement title, file number, former creditor designation and every communication about the alleged change. A payment demand does not by itself prove the transfer under section 9 EO.

Record the court file →

What section 9 EO requires after an assignment

Section 9 EO addresses enforcement in favour of a person other than the person named as entitled in the enforcement title. The claim recognised in the title must have passed from the named person to the person seeking enforcement or continuation.

Public or publicly certified documents must prove that transfer. This is a procedural requirement of its own. The new creditor should therefore bring the title, the exact claim description and the former party designation together with the assignment document.

Document review

Connect assignment, title and continuation request

Each document answers a different question about the party change.

Document and function in a continuation request
Document Review question Function
Enforcement title Which claim is recognised? Record the amount, parties and content of the title.
Assignment document Has the claim passed? Check the public or publicly certified form required by section 9 EO.
File number Which case should continue? Identify the specific enforcement proceeding.
Application What should the court do? Describe the transfer and requested continuation clearly.

A document helps only when it connects the titled claim and the change of party in a traceable way.

Distinguish an assignment document from a private contract

A claim may pass under a contract. For enforcement in favour of the new creditor, the documentary proof required by section 9 EO is an additional issue. A private assignment agreement may be an important basis, but it does not automatically meet the special form required by section 9 EO.

Check whether the document clearly identifies the former and new creditor, debtor, enforcement title and transferred claim. For a partial assignment, it must also be clear which part of the titled claim is concerned.

Key point: Putting the new creditor's name on an invoice or payment demand does not replace documentary proof of the transfer under section 9 EO.
Procedure

Prepare the creditor change in four steps

This order keeps an incomplete proof separate from the continuation request.

  1. 01
    1

    Identify the case

Secure the file number, court, former party and stage of the enforcement against real property.

  2. 02
    2

    Reconcile the claim

Compare the enforcement title, claim scope and assignment document.

  3. 03
    3

    Check the form

Review the public or publicly certified document required by section 9 EO.

  4. 04
    4

    Request continuation

Set out the transfer and requested next step before the enforcement court.

What section 10 EO means when proof is missing

If the documentary proof required by section 9 EO cannot be produced, section 10 EO requires a court judgment before enforcement is authorised or continued. The judgment is therefore the statutory route where the documentary proof is unavailable. It does not remove the need to assess the particular claim.

The new creditor should state what supports the alleged transfer and whether the required document is available. Trying to bridge a missing form requirement with a bare statement that the claim was purchased leaves the procedural basis incomplete.

Keep continuation, joinder and distribution separate

A change of the enforcing creditor is different from a further creditor joining the proceeding. Section 139 EO addresses the situation in which additional creditors join an auction proceeding that has already been initiated. This article concerns the person to whom the already titled claim is said to have passed.

Ranking and later distribution of the highest bid require a separate review. For a party change, the title, transfer document, file number and procedural stage come first. The current file can be organised with the court-file review.

FAQ

Common questions about a creditor change

Is a private assignment agreement enough for continuation? +
Not automatically. Section 9 EO requires public or publicly certified documents proving that the titled claim passed to the new creditor. If that proof is missing, section 10 EO requires a court judgment before continuation.
Does the new creditor need a new enforcement title? +
The existing title remains the starting point. The key issue is whether the transfer of the claim recognised in that title is proved in the form required by section 9 EO. Section 10 EO applies where documentary proof is unavailable.
Is a creditor change the same as joinder under section 139 EO? +
No. A creditor change concerns a titled claim passing to another person. Section 139 EO concerns additional creditors joining an ongoing auction proceeding.
