If an auction hearing is cancelled or moved, the existing court file remains decisive until the enforcement court announces the next procedural step. This primarily affects the Vadium, the auction notice and whether a deadline already running continues.

A cancelled hearing is neither an award nor automatically a new bidding procedure. The relevant documents are the specific court order, the new notice and the date on which the affected person received them.

Which document decides the next step?

Start with the court notice, the former edict and any new auction notice.

What did the court communicate?

01

Compare the order and the new auction notice

Put the cancellation order, the former edict and every later notice in date order. This shows whether a new hearing has been fixed and which conditions currently apply.

02

Do not infer the new hearing from the old edict

Compare the date, minimum bid, Vadium and auction conditions in the new notice with the cancelled hearing. A moved date alone does not answer every question about deadlines and documents.

03

Document the Vadium and the court deposit

Keep the payment confirmation or savings certificate and use the court notice to establish whether the deposit is retained, repaid or must be evidenced again for the new hearing. The old document alone is not conclusive.

Cancellation, postponement and a new hearing

A cancellation ends the announced hearing in that form. A postponement initially changes the date. In both situations, the current court file governs. The former auction edict should not be used as the sole basis for the new bidding hearing.

Read the wording of the court communication carefully. It may announce a new hearing, require a further notice or merely record that the former hearing will not take place. The next step follows from the file, not from a general assumption about the procedure.

What the new auction notice can determine

The edict or auction notice must set out the information relevant to bidding in a consistent way. This includes the date, the property, the minimum bid, the Vadium and the applicable conditions. Section 168 EO governs the announcement of material information; the detailed provisions of the Enforcement Code must be read with the specific notice.

Do not compare only the date. Mark every difference in the valuation, minimum bid, encumbrances to be assumed, inspection arrangements, bidding period and Vadium. Information from the former hearing may be outdated once a new notice is issued.

The Vadium after a cancelled hearing

The Vadium secures participation in the bidding procedure. Whether a deposit already lodged can be used for a new hearing depends on the court’s handling and the new notice. The payment confirmation or savings certificate proves what was actually lodged. It does not replace a review of the current court communication.

Anyone who pays the Vadium again without clarifying repayment or credit risks tying up funds twice. Anyone who treats the old deposit as automatically sufficient risks missing the requirements of the new hearing. Keep the proof, case number and court notice together.

Deadlines do not automatically start again

Cancelling an auction hearing does not automatically reset every deadline in the enforcement proceeding. A deadline may be linked to service, a court order or a legally defined procedural act. The date originally planned for the hearing is not always the relevant starting point.

For a deadline question, read the service information and the legal-remedies notice on the specific document. A new auction notice may contain new information for the next hearing, but it does not automatically replace the need to examine a deadline connected with an earlier order.

Documents for owners and bidders

Owners should arrange the court communication, former edict, valuation report, land-register extract and any applications in chronological order. Bidders also need the Vadium payment confirmation, the current notice and their financing documents. This makes clear which information belongs to the former hearing and which applies to the new one.

Preparation for the concrete courtroom process is also useful. The article Prepare for the court hearing and auction file explains the relevant file and bidding questions.

How to classify the court communication

A short message saying that a hearing is cancelled does not necessarily show that a new hearing has already been fixed. Check whether it identifies an order, which court issued it, when it was served and what further action it mentions. If documents conflict, record their sequence in the file note.

For a new hearing, also establish whether the proceeding continues unchanged or whether the notice contains new conditions. This matters if an application, suspension, valuation change or court decision occurred between the two hearings.

Review matrix

Cancellation or postponement: which proof governs?

The former hearing notice and the current court file serve different purposes.

Documents and their function after a hearing change
Situation Central question Proof
Cancellation Has a new hearing been fixed? Cancellation notice and later auction notice
Postponement Which conditions apply on the new day? Current edict and court file
Vadium lodged Is the deposit carried over or requested again? Payment proof, savings certificate and court communication
Deadline What triggers the deadline? Service, order and legal-remedies notice
Process

Work safely after a cancelled hearing

This sequence prevents former hearing details from being mixed with the current procedural position.

  1. 01
    1

    Secure the notice

File the cancellation or postponement notice with service date and case number.

  2. 02
    2

    Compare the edict

Compare former and current notices for date, bid, Vadium and conditions.

  3. 03
    3

    Clarify the deposit

Assign the Vadium to the new hearing using the proof and court information.

  4. 04
    4

    Review deadlines

Check service and the specific order instead of starting with the planned hearing date.

Important: Cancelling an auction hearing does not automatically mean that the Vadium is repaid or carried over. The court’s handling and the current notice govern.
FAQ

Frequently asked questions about a cancelled hearing

Do I have to lodge the Vadium again after a hearing is cancelled? +
There is no universal answer. Check the court communication and the new notice together with the payment confirmation or savings certificate. Those documents must show how the previous deposit is treated.
Do all deadlines restart after a postponement? +
No. A postponement does not automatically reset every deadline in the enforcement proceeding. Service, an order or a specific procedural act may be decisive, so review the legal-remedies notice and proof of service.
Does the former auction edict remain valid for the new hearing? +
Do not rely on the former edict alone. Compare the current notice with the former position, especially the date, minimum bid, Vadium and conditions.
