Where insolvency proceedings are opened in another EU Member State while the debtor owns property in Austria, a mortgage must be assessed separately. Article 8 of Regulation (EU) 2015/848 protects an existing right in rem, subject to its conditions, against the effect of the opening of proceedings.
The assessment therefore connects the proceeding, its opening date, the location of the property and the content of the security. A personal claim, a registered mortgage and a possible challenge to the security each raise a separate question.
Separate the foreign insolvency proceeding, the location of the property and the right in rem. This check does not replace a file review.

Collect the opening order, the date and the designation of the proceedings. Only then can the cross-border protection rule in Article 8 be assessed.
Record the Austrian location of the property and the opening date using the land register documents and the opening order. Article 8 connects the protection to this time and place.
Compare the land register, mortgage deed, amendments and claim documents. An outstanding balance alone does not prove a right in rem or its scope.
Record the personal claim separately from any property security. Article 8 protects a right in rem subject to its conditions; it does not turn an unsecured claim into a mortgage.
Bring together the opening order, land register, mortgage deed and claim balance. Article 8 protects the existing right in rem, subject to its conditions, against the effect of opening the proceedings. The practical enforcement route requires a separate review.
Record indications of voidness, voidability or relative ineffectiveness separately. Article 8(4) preserves this review under Article 7(2)(m).
Article 8(1) of Regulation (EU) 2015/848 combines three points of connection. Insolvency proceedings must have been opened, the asset must have been located in the territory of another Member State when they opened, and the issue must concern a right in rem held by a creditor or a third party. For Austrian property, this describes proceedings opened in another EU Member State while the property is in Austria.
The rule protects the right in rem against the effect of opening the proceedings. The timing matters: the property location at the opening date is decisive for this connection. The opening order, the opening date and the land register position therefore belong in the same review.
The creditor topic page helps organise the title, claim and security. The cross-border issue also requires a careful review of the foreign opening order.
Article 8(2)(a) refers in particular to the right to realise an asset or have it realised and to obtain satisfaction from its proceeds or fruits. The provision expressly names a pledge and a mortgage. The protection review therefore concerns the right in rem over the property and the satisfaction connected with it.
A mortgage has a different function in this review from the loan agreement or the personal repayment claim. The loan agreement explains the claim against the debtor. The mortgage deed and land register position show whether and to what extent the claim is intended to be secured by the property. The mortgage glossary entry provides a basic terminology guide for the file review.
Article 8 does not support a blanket forecast of a particular realisation amount. The protection answers whether the opening of proceedings affects the right in rem. Priority, existence, scope and the practical realisation route require their own assessment.
Article 8(3) treats a right entered in a public register and enforceable against everyone to acquire a right in rem as a right in rem. This protection also depends on the conditions of the rule and the specific content of the registered right. A reference to a planned security is insufficient for the classification.
Article 8(4) preserves the review of whether a legal act is void, voidable or relatively ineffective under Article 7(2)(m). Protection against the effect of opening the proceedings therefore does not remove that separate issue. Concerns about the creation of the security, a later amendment or the legal basis must be documented on their own terms.
Article 8 also does not answer every question about how realisation in Austria is continued or administered. This distinguishes the issue from the article on the assumed mortgage claim after the award, which deals with a different stage of the proceedings.
The first review requires the foreign opening order with its date and designation of the proceedings. Add a current Austrian land register extract, the mortgage deed and amendments, any assignment documents and a traceable claim statement. This makes it possible to separate the personal claim from the right in rem.
Also collect notices from the foreign insolvency court, the insolvency practitioner and the Austrian court where a realisation proceeding is already pending. The article on a stay of a judicial auction addresses a different legal issue, but illustrates why the current file and concrete procedural documents matter.
For documents in another language, arrange the translation so that the opening date, participant role, property description and security content remain clear. A document list with date and legal relevance then supports the review of protection, existence, priority, scope and possible objections.
Article 8 addresses distinct questions with distinct legal effects.
| Review field | What is the question? | Core documents |
|---|---|---|
| Proceeding | Were insolvency proceedings opened in another EU Member State? | Opening order, date and designation of proceedings |
| Location | Was the property in Austria when the proceedings opened? | Land register, property description and opening date |
| Right in rem | Is there a mortgage with the protected realisation position? | Land register, mortgage deed and amendments |
| Personal claim | What claim exists independently from the property security? | Agreement, balance, payments and assignments |
| Limit | Is there a question of voidness, voidability or relative ineffectiveness? | Creation documents, amendments and procedural notices |
The concrete assessment depends on the complete file and the conditions of Article 8 of Regulation (EU) 2015/848.
