Auction
Owner checklist

Order the file as an owner

This list organises documents on the court, property, financing and use. It does not replace a lawyer’s examination of the individual case.

First organise the complete file. This list identifies typical documents and connects them with the next review steps.

Ticked items remain local in your browser; printing and resetting are available.

Work through the four areas in order.

0 of 14 done

01 Court and service

Keep every court document in the form in which it was actually served.

02 Property

The current status of the property is the basis of any assessment.

03 Financing

Compile outstanding balances and previous arrangements clearly.

04 Use and possession

Document who currently uses the property and on what basis.

Legal framework

The starting point of a judicial real-estate auction is § 133 Enforcement Act. The valuation relates to § 141 Enforcement Act. Changes to the statutory auction conditions are governed by § 146 Enforcement Act. The available steps depend on the complete file and the specific service details.

This checklist gives a general orientation on Austrian law and does not replace a lawyer’s examination of the individual case.
