Use this list to record use and possession, auction conditions, financing, your bid ceiling and open questions from the valuation and land register before the hearing.

Work with the current edict, the court auction conditions, the valuation report and a current land register extract. Record contradictions and missing information with a page number or land register reference instead of relying on memory.

Legal framework

Under section 141 of the Austrian Enforcement Act, the valuation is generally carried out under the Real Estate Valuation Act and the relevant date is the date of the inspection. Record the valuation date, actual use and identifiable changes since the inspection separately.

Section 146 of the Austrian Enforcement Act allows the court to alter statutory auction conditions where the legal requirements are met. The conditions in the specific proceeding therefore matter. This checklist makes no statement on value, the award or whether an individual right survives.
